# Terms of Service

**Draft. Not reviewed by a lawyer.** Written to be accurate about how the
software behaves, so it is an honest starting point — but it is not legal
advice and must be reviewed before Duru is offered to anyone but you. See
"Before you publish this" at the end.

## Who you are contracting with

Duru is provided by **Silvan Jost**, an individual trading as Duru, not a
company.

## 1. What Duru is

Duru turns material you provide into an ordered course: it extracts vocabulary
and grammar, schedules review, generates practice, and provides an AI tutor you
can talk to.

Duru is a study tool. It is not a teacher, a tutor service, a qualification, or
a substitute for instruction from a qualified person.

## 2. Your account

You need an account. Keep your credentials secure; you are responsible for
activity under your account. Tell us promptly if you believe it has been
compromised.

You must be at least 16. Duru is not designed for children and has no
parental-consent mechanism.

## 3. The material you upload

This is the most important section, because it is where the real risk sits.

**You keep ownership of what you upload.** We claim no rights in your material
beyond what is needed to run the service for you.

**You must have the right to upload it.** By uploading, you confirm you own the
material or are otherwise permitted to use it this way. Uploading a textbook you
bought does not automatically give you the right to transmit it to a third-party
AI provider — check the licence.

**Uploaded material is sent to AI providers.** Extracting vocabulary from a PDF
means transmitting that PDF to OpenRouter, which routes it to a model provider.
If you are not comfortable with a specific document leaving our servers, do not
upload it.

**You are responsible for what you share.** If you share a course, you are
responsible for having the right to distribute its contents to the people you
share it with.

We may remove material we believe infringes someone's rights, and we may
suspend accounts that repeatedly do so.

## 4. AI output is not reliable

Extractions, translations, example sentences, grammar explanations, test
questions, corrections and tutor conversations are generated by AI models. They
will sometimes be wrong, including confidently wrong.

- Extracted content is a **draft for you to review**, which is why the app
  always lets you edit it before it is used for study.
- Do not rely on AI output where being wrong matters — exams, professional
  translation, legal or medical contexts, or anything with consequences.
- We do not warrant that generated content is accurate, complete, or
  appropriate for your level.

## 5. Acceptable use

Do not:

- Upload material you have no right to use, or anything illegal.
- Use Duru to generate abusive, harassing, deceptive or illegal content.
- Attempt to extract the underlying model prompts, bypass access controls, or
  access another user's data.
- Resell or redistribute the service, or use it to build a competing dataset.
- Automate abusive volumes of requests. AI processing costs real money per
  request, and we may rate-limit or suspend accounts that make the service
  uneconomic to run.

## 6. Availability

Duru is provided as-is, with no guarantee of uptime, and it depends on
third-party AI providers whose availability we do not control. Features may
change or be removed. We may need to take it down for maintenance.

## 7. Your data

How data is handled is described in [PRIVACY.md](./PRIVACY.md), which forms part
of these terms.

You can delete your material at any time. Deleting a course deletes its
lessons, extractions, generated practice and review history.

## 8. Ending your use

You can stop and delete your account at any time.

We may suspend or terminate accounts that breach these terms, that put the
service at legal risk, or that make it impractical to operate.

## 9. Liability

To the maximum extent the law allows, Duru is provided without warranties, and
we are not liable for indirect or consequential loss, lost data, or loss
arising from reliance on AI-generated content.

Nothing here limits liability that cannot legally be limited.

## 10. Changes

We may update these terms. Material changes will be communicated before they
take effect.

## Before you publish this

These need professional review:

1. **Governing law and jurisdiction** — deliberately omitted, and required.
2. **The postal address** above is still blank and is legally required. Trading
   as an individual is fine and is stated; the address is the missing half, and
   an email address does not substitute for it.
3. **Liability caps and consumer rights.** Consumer protection law in the EU/UK
   overrides several common limitation clauses; a template that ignores this is
   partly unenforceable.
4. **DMCA / copyright takedown process** — a named agent and a documented
   procedure are needed before any public course sharing.
5. **Payment, refunds and subscription terms** — none of that exists here yet
   and none of it is covered.
6. **AI provider terms** flow down to your users; those obligations should be
   reflected here.
7. **Minors and school use**, before any school pilot.
